[Gamified Labs Inc.] (“Esotico Lifestyle”, “we”, “us” and “our”) respects the privacy of each customer and prospective customer (“Customer” or “you”). Esotico is committed to protecting all Personal Information (as such term is described below) collected from Customers.

This Privacy Policy (the “Privacy Policy”) is intended to ensure that Customers are aware of the purposes for which Esotico collects personal information and the manner in which personal information is used, protected, stored and disclosed by Esotico. This Privacy Policy contains important information concerning Esotico’s commitment to the protection of your Personal Information, including (which in this Privacy Policy means “including without limitation”) the meaning of the term “Personal Information”, the purposes for which we collect and use your Personal Information, when and how we collect and share your Personal Information, how we protect your Personal Information, the manner in which you may access, correct or update your Personal Information, and how to contact Esotico about privacy matters.

By doing business or communicating with Esotico, visiting Esotico’s website or subscribing to Esotico’s communications, you agree to Esotico collecting, using and disclosing your Personal Information in accordance with this Privacy Policy.

Personal Information

For the purposes of this Privacy Policy, “Personal Information” means information about an identifiable individual, including, for example, a Customer’s name, home address, email address, telephone number, date of birth and purchasing information.

Personal Information does not include aggregated information or any personal information that has been de-identified by removing potentially identifying details such that the data may not be linked to a particular individual.

Purposes

Esotico collects, uses and discloses Personal Information for the general purpose of operating its business and, more particularly, for specific purposes including the following (the “Purposes”):

to communicate with Customers regarding orders, purchases, returns and other relevant matters and respond to Customers’ inquiries;
to process information related to Customers’ orders, purchases and returns;
to provide services, products and benefits to Customers;
to understand and analyze the interests, needs and preferences of Customers;
to develop, market, recommend and/or provide products, services and benefits to, or to meet the needs and interests of, Customers;
to verify Customers’ identities as required or when desirable for transactional purposes, so as to reduce fraud or errors in the processing of transactions;
to advise Customers of changes to this Privacy Policy;
to comply with applicable legislative and regulatory requirements; and
for investigation and law enforcement purposes.

Esotico does not collect Personal Information from Customers other than for the purposes identified in this Privacy Policy, unless such collection of Personal Information is otherwise required or permitted by law or unless further consent is obtained.

Esotico collects Personal Information from Customers on a number of occasions, including, but not limited to, when a Customer uses its website, when a Customer subscribes for e-mail communications or when a Customer makes a purchase, return or inquiry.

Sharing

From time to time, we may disclose to third parties aggregated or de-identified data which does not contain Personal Information.

Esotico may share or transfer your Personal Information where reasonably required in the context of a sale, merger, reorganization or amalgamation of all or part of its business. The recipient parties will be contractually required to keep the information confidential and use it only for the purposes of the transaction, or proposed transaction. If a business transaction is completed, assignees or successors of Esotico’s business or assets may use and disclose your Personal Information, as obtained from Esotico, only for the purposes set out this Privacy Policy, unless your further consent is obtained.

Esotico may also share your Personal Information with third parties as required or permitted by law. For example, your Personal Information may be provided to or shared with third parties pursuant to a warrant, order or statutory requirement, in connection with any legal proceedings or prospective legal proceedings involving Esotico or in order for Esotico to otherwise exercise its legal rights (including to prevent fraud and reduce credit risk).

Esotico will take reasonable measures to ensure that the Personal Information that we collect is accurate and complete. We will update our records regarding Customers based on the information that we receive directly or indirectly from Customers. You are responsible for advising Esotico of any relevant changes to your Personal Information, such as a change of name or contact information.

Our website may contain links to other websites. We are not responsible for the privacy practices or the content of any websites to which we provide links. You should check the privacy policies of these other websites before choosing to provide any Personal Information through such third party sites.

When you visit Esotico’s website, we may use certain automated tools to provide you with a more personalized browsing experience, better understand your needs, provide you with content that is most relevant to you and monitor trends respecting the usage of the site.

Tracer Tags & Web Beacons

Esotico’s website may also use a technology called "tracer tags" or “web beacons”. A web beacon is a small transparent graphic image that allows Esotico to record simple user actions related to its website and to its email communications to help Esotico determine the usage and effectiveness of its site and email communications. These “images” are automatically loaded to your browser/device when you visit Esotico’s website or open an HTML format email message from Esotico to let Esotico know if a certain page was visited or email message was opened. This technology allows Esotico to identify which pages you visit on its website and is used to help Esotico optimize and tailor its website for you and future visitors.

Retention

Esotico will only retain Personal Information to the extent necessary to fulfill the purposes identified in this Privacy Policy or satisfy the terms on which you otherwise consent to our use of your Personal Information, after which your Personal Information will be securely destroyed or irreversibly erased or de-identified. As noted below, you may request that your Personal Information be deleted. Note that, in some cases, Esotico may retain some of your Personal Information for a reasonable period of time for legal, administrative or compliance purposes.

Esotico has established appropriate technological, physical and contractual security measures designed to help protect Personal Information against loss or theft or unauthorized access, disclosure, copying, use or modification and has implemented security safeguards which are commensurate with the sensitivity of the Personal Information.

Your Options

Esotico provides you with a number of options which allow you to select certain preferences with respect to our use of your Personal Information, obtain access to the Personal Information that we hold about you, or request that such Personal Information be revised or deleted.

Opting Out

Subject to certain legal and contractual restrictions, you may withdraw your consent to our use or disclosure of your Personal Information at any time; however, if you withdraw your consent, Esotico may be unable to continue to do business with you or the manner in which Esotico can do so may be limited.

Direct Marketing

With your consent or as otherwise permitted by law, we may, from time to time, use Personal Information to communicate with you regarding promotions and other pertinent matters such as products and services, as described above under “Purposes”.

If you would prefer not to receive such communications from Esotico, you may opt-out at any time by contacting Esotico using the contact information provided under “Contact Us” below. If you receive promotional email messages from Esotico, you may unsubscribe from such messages by using the unsubscribe mechanism found in all such messages.

Access and Correction

Except as provided by law, upon request, Customers may examine the Personal Information that Esotico holds about them. In circumstances in which Esotico is unable to provide you with access to all of the Personal Information it holds about you, Esotico will advise you of the reasons why it is unable to do so. If Esotico receives a request from a Customer to examine the Personal Information that Esotico has collected and retained about the Customer, Esotico will respond to the request within 30 days.

You may request access to your Personal Information by making a request, in writing, to the Esotico Privacy Officer using the contact information provided under “Contact Us” below. Please be advised that, in an effort to prevent fraudulent or unauthorized requests for access, we may request identification for authentication purposes.

If, upon examining the Personal Information that Esotico holds about you, you believe that any of this Personal Information is inaccurate or incomplete, you may make a written request to the Esotico Privacy Officer that this Personal Information be corrected. Subject to legal and contractual restrictions, you may also request that your Personal Information be deleted; however, the deletion of all or some of your Personal Information may impact Esotico’s ability to provide you with certain services.

Changes and Updates

Esotico may revise this Privacy Policy from time to time.

When we make changes to this Privacy Policy, we will update the “Last Updated” date at the top of the Policy. You should review the Privacy Policy periodically to determine whether any changes have been made. If we make substantial changes, we will, as appropriate, post these changes to Esotico’s website or notify registered Customers.

If you disagree with any change to this Privacy Policy, you may refrain from using Esotico’s services. Continuing to use our services, including our website, after we post or communicate a change signifies that you consent to the revised terms of the Privacy Policy.
